What changes are coming in October?

The Employment Rights Act 2025 is being introduced in stages, with several further measures scheduled for October 2026.

From 1 October 2026, the time limit for bringing an Employment Tribunal claim will increase from three months to six months. For breach of employment contract claims in Scotland, the equivalent change will take effect from 9 November 2026.

Further changes will take effect from 30 October 2026, including strengthened protections relating to sexual harassment and new trade union rights.

Employers will be required to take “all reasonable steps” to prevent sexual harassment of employees, alongside a new obligation not to permit harassment of employees by third parties.

October will also see changes relating to trade union rights, including new statutory rights of access to workplaces and provisions relating to trade union recognition and representation.

With the reforms being introduced in stages, keeping track of what applies and when can be challenging, particularly for smaller businesses and independent clinics.
